RESOLUTION NO. 3575
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF CORTE MADERA SETTING THE FY 2009-2010 FEES FOR RESERVED USES OF TOWN’S OUTDOOR FIELDS AND FACILITIES, RECREATION CENTER, NEIL CUMMINS GYMNASIUM, AND FEES FOR SPORTS, CLASSES, AND ACTIVITIES, AND AUTHORIZING AND DIRECTING THE TOWN MANAGER AND HIS DULY AUTHORIZED OFFICERS AND AGENTS TO CARRY OUT THE PURPOSES OF THIS RESOLUTION

WHEREAS, the Town of Corte Madera (hereinafter referred to as “TOWN”) provides facilities which may, by permit, be reserved for use at Corte Madera Town Park, San Clemente Park, Menke Park, Piccolo Pavilion, Granada Park, Corte Madera Recreation Center, Recreation Center Readerboard, and Neil Cummins School Gymnasium; and
WHEREAS, the TOWN also provides facilities for annual and seasonal use by permit at Corte Madera Town Park, San Clemente Park and Neil Cummins Gymnasium for organized groups such as the Mill Valley Soccer Club, Twin Cities Little League, and St. Patrick’s CYO Basketball; and
WHEREAS, the TOWN provides sports leagues, classes and activities at reasonable fees, and is able to offer such recreation programs with fees charged toward covering the costs of providing said programs; and
WHEREAS, the TOWN’S fees for recreation facilities and programs, as described above, that are currently charged were established by Resolution No. 3544 on February 19th, 2008 and
WHEREAS, it is in the public’s best interest that the Council review fees from time to time and make any modifications to those fees that may be necessary to continue to offer the programs and facilities to the public in an amount that will substantially cover the costs of the TOWN in providing said programs and facilities; and
WHEREAS, a notice of public hearing was published in a newspaper of general circulation within the Town in accordance with notice and publication requirements, advertising a public hearing to be held at the Town Council Chambers at 300 Tamalpais Drive, Corte Madera at the time of 7:00 P.M. on the date of December 2, 2008, inviting public testimony concerning the setting of recreation programs and facilities fees for the Fiscal Year 2009-2010; and
WHEREAS, a public hearing was held at the date, time and location set forth in the notice of public hearing, concerning the fees to be charged for recreation programs and facilities as set forth by this resolution; and
WHEREAS, Town staff has provided the Town Council with data, analyses, and information supporting its conclusions and recommendations concerning the fees to be charged for recreation programs and facilities as set forth by this resolution; and
WHEREAS, TOWN has reviewed the fees currently being charged under Resolution No. 3544 and the costs incurred by the TOWN in offering and operating the programs during the most recently completed fiscal year; and
WHEREAS, the TOWN’s policy has been to gradually work toward recovering 100% of its costs in offering and operating the programs and facilities of its recreation department, while not fully recovering such costs at this time; and
WHEREAS, Town staff has determined that in all instances fees currently being charged do not entirely cover the actual costs of offering and operating the programs or facilities during the most recently completed fiscal year, and in some instances an increase in the fees is necessary for the TOWN to recover nearly 100% of its costs and continue offering and operating the programs or facilities without diverting funding that has been appropriated for some other use; and
WHEREAS, if in those instances that the fees are significantly lower than the costs incurred by the TOWN such fees are not increased, the TOWN would either be unable to continue to provide the program or facility or would be offering and operating the program or facility at a cost to the TOWN which would need to be paid for out of funds appropriated for some other use; and
WHEREAS, the TOWN has determined that the fees set forth below are reasonable to defray the costs incurred by the TOWN to provide the programs and facilities identified below to the public during Fiscal Year 2009-2010;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
Section I. The Town Council hereby adopts the findings set forth above and sets the fees being charged for Parks and Recreation programs and facilities in the amounts set forth by the following sections of this resolution.
Section II.
For the purposes of this resolution, “Residents” shall mean, the following:
A) for the use of facilities and programs located on property owned by the Larkspur School District (Neil Cummins Gymnasium, San Clemente Park, Town Park Summer Playground Program, Softball and Soccer fields located in the northeast portion of Town Park and the southeast portion of Neil Cummins School, Tennis Courts at Granada School, and Sand Volleyball Court at San Clemente School), “residents” shall mean individuals who reside in, or groups and organizations which have their principal place of business located within, the County of Marin;
B) for the use of all other facilities and programs (Picnic Areas, Piccolo Pavilion, Town Park with the exception of those areas mentioned in (A) above, Recreation Center, Recreation Center Reader Board and Tennis Courts at Town Park) “residents” shall mean individuals who reside in, or groups and organizations which have their principal place of business located within, the Town of Corte Madera.
C) for the purposes of this resolution, all fees will be assessed at those amounts which are in effect during the fiscal year of the scheduled activity, subject to the following exception: the summer playground program shall be assessed at the amount of the fee set by this resolution, regardless of the fiscal year in which the program may begin.
Section III.
RECREATION CENTER FACILITIES
The hourly use fees/charges applicable to users of the TOWN’S Recreation
Center shall be:
A. RECREATION CENTER RESIDENTS NON-RESIDENTS

(4 hour minimum)
B. ADDITIONAL FEES (all fee’s must be paid at time of reservation)
Cleaning and Damage Deposit: depending upon type of activity
$500.00 - $2000.00.
Overtime: Any time used over contracted time will be billed at double the rate per hour.
Security: The cost of necessary contracted security, plus 10% for overhead, will be borne by the renter.
C. READER BOARD
The use fees/charges applicable to users of the TOWN’S Reader board shall be:

OUTDOOR FACILITIES
The one-day use fees/charges applicable to users of the TOWN’S outdoor fields and facilities shall be:

Section VI.
KIDS CLUB AFTERSCHOOL PROGRAM
The After school Program use fees shall be applicable to users of the
Town’s before and after school program at the rate of:

Non-School Days
Ages 5 – 12 $40.00/day
Section VII.
SUMMER PLAYGROUND PROGRAM
The Summer Playground Program registration fees shall be applicable to
users of the Town Park and San Clemente School programs, and shall be the annual one-
time registration fee for the publicized program, or for any part thereof:
A. SUMMER PLAYGROUND RESIDENT NON-RESIDENT

Section VIII.
RECREATION DEPARTMENT PROGRAM FACILITY RATES
The cost recovery goal applicable to the TOWN’S recreation programs, excluding the subsidized senior programs, shall be to eventually achieve a balance between revenue and expenses that reflect a 100% cost recovery. Providers of classes, activities or events at which fees are charged to participants shall pay the following fees for use of town facilities:
A. Main Hall $35.00 / hour

C. Backroom $8.00 / hour
D. Kitchen $9.00 / hour
E. Athletic Fields $95.00/hour
F. Tennis Courts $41.00 / hour
G. Menke Park $30.00 / hour

I. Neil Cummins Gym $53.00 / hour
J. Registration Fee for offsite programs $12.50 / per registrant
Section IX.
The use fees/charges, excluding duty staff, applicable to users of the TOWN’S parks and recreational facilities shall not be applied to:
A. TOWN SPONSORED PROGRAMS
Town Council, Boards/Commissions, Town Departments, Twin Cities
Police Department, Corte Madera Volunteer Firefighters Association,
and Marin County Food Bank.
B. TOWN HOMEOWNERS’ ASSOCIATIONS
Annual meetings of TOWN’S bona fide Homeowners’ Associations held in the Recreation Center shall be charged $35 per hour for proactive costs. Charges for the use of other Town facilities shall be at standard resident rates.
C. TOWN CIVIC ORGANIZATIONS
Fee waiver is contingent upon current Building Use Agreement between
TOWN and Organization.

D. LARKSPUR SCHOOL DISTRICT
Fee waiver is contingent upon current Joint Powers Agreement and Joint
Use Agreement between TOWN and District.
Section X. In those instances where the Town has sole authority to grant permission to persons (“permittee”) wishing to use a Town-owned facility or a facility the use of which is controlled by the Town, the permittee shall not charge those participating in the permittee’s activities conducted at the facility a fee or other charge that differentiates between the participants based on the participants’ residency or place of business.
Section XI. The Town Manager, his duly authorized officers and agents, be and the
same hereby are, directed to carry out the purposes and intent of the Resolution. This
Resolution shall take effect on. July 1, 2009, except as provided by the following section of this resolution.
Section XII. Resolution 3544 establishing the FY 2007-2008 Parks and Recreation Fees is hereby rescinded as of July 1, 2009, with the exception of those fees established by Resolution No. 3544 for the Summer Playground Program, which fees are rescinded as of December 31, 2008, and are replaced by Section VII of this resolution effective January 1, 2009.
